1. Aims, controller and minimum age

This data protection statement has been issued to explain the nature, scope and aim of processing (e.g. collecting, processing and using as well as obtaining consent) personal data within the bounds of our website and its associated web pages, features and content (hereinafter collectively referred to as the “Website”). The data protection statement applies irrespective of the domains, systems, platforms and devices (e.g. desktop PCs or mobile phones) used on which the Website is running.

The website provider and data controller is:

VWS Befestigungstechnik GmbH

Phone: +49 (0)7129 - 695 - 100
Fax: +49 (0)7129 - 695 - 150

(hereinafter referred to as the “Provider” or “we” or “us”). Our contact details can be found under “Site info”.

Users must be at least 16 years of age in order to consent to this data protection statement, unless individual member states of the European Union prescribe a lower minimum age of 13.

The term “User” includes all customers and visitors to our Website. All terminology used on this Website, e.g. “User”, is applied in a gender-neutral context.

2. Content warning

Although the free-of-charge and freely accessible content on this Website has been compiled with the greatest of care, the Website Provider cannot accept any responsibility or liability for the accuracy or currentness of the free-of-charge and freely accessible journalistic advice and news provided here.

Articles citing the name of the author reflect the opinions of the contributing party thus named and not necessarily those of the Website operator.

3. External links

This Website contains links to third-party websites (“external links”). These websites are the responsibility of the respective operator. The Provider checked the third-party content the first time that the external links were created to ensure that no laws had been violated. No such violations were apparent at the given time. The Provider has no influence whatsoever on the current and future format or the content of these externally linked websites. Creating such external links does not imply that the Provider adopts or identifies with the content to which the link is directed.

It is unreasonable for the Provider constantly to check these external links unless there are sufficient grounds to assume that laws have been violated. If it is determined that laws have been violated, the external links in question will be deleted immediately.

4. Copyright and other ancillary copyright

The information published on this Website is subject to German copyright and ancillary copyright law. Any use not permitted by German copyright and ancillary copyright law requires the prior written consent of the Provider or the respective owner. This especially applies to the duplication, editing, translation, storage, processing and reproduction of content in databases or other electronic media and systems. Third-party content and rights are marked as such. The unauthorised duplication or reproduction of individual content or entire pages is prohibited and is a criminal offence. Content may only be copied and downloaded for personal, private and non-commercial use.

This Website may only be presented in external frames subject to written consent having been provided.

The use of the contact data found under Site Info for advertising purposes is hereby expressly discouraged, unless the Provider has issued its prior written consent to do so or a business relationship already exists. The Provider and every person named on this Website hereby reject any commercial use or disclosure of their data.

5. Fundamental information on data processing

We only process user-related personal data in compliance with the relevant data protection regulations and in due keeping with the spirit of data economy and data avoidance. This means that user-related data are only processed if so permitted by law, in particular if the data are required by law and/or are needed in order for us to provide the contracted services as well as our online services, or if the corresponding user has furnished their consent.

In doing so, we shall, under no circumstances, collect customer data pertaining to their race, ethnic origin, political opinions, religious beliefs or ideologies, their trade union affiliation or sexual orientation.

We implement organisational, contractual and technical security measures in accordance with the latest technology so as to ensure that data protection legislation is complied with and the data processed by us are protected from accidental or intentional manipulation, loss, destruction or access by unauthorised persons. The security procedure adopted to achieve this (SSL - secure sockets layer) is state-of-the-art technology and used, for example, by banks as a data protection tool for online banking.

Insofar as content, tools or other means are used by other providers within the context of this data protection statement (hereinafter jointly referred to as “Third-Party Providers”) whose registered place of business is located abroad, it may be assumed that data will be transferred to the countries where Third-Party Providers have their registered place of business. Data are transferred to third countries either on the basis of a legal authorisation, the user’s consent, or special contractual clauses that safeguard the statutory data security standards.

6. Processing of personal data

Personal data are, in addition to the use expressly stated in this data protection statement, processed on the basis of legal authorisations or user consent for the following purposes:

  • To provide, perform, maintain, optimise and secure our general and user services;
  • To ensure effective customer service and technical support.

We only transmit user data to third parties if this is required for invoicing purposes (e.g. to payment service providers) or for other purposes if required to fulfil our contractual obligations to our users (e.g. provision of address details to suppliers).

When we are contacted (via the contact form or by e-mail), the user’s details are saved in order for the request or enquiry to be processed and in the event that there are follow-up questions.
Personal data are erased once they have fulfilled their purpose and there are no obligations to preserve such data.

7. Collection of access data

We collect data every time the server on which this service is located is accessed (so-called server log files). Access data include the name of the website visited, the file, the date and time of the visit, the data volume transmitted, notification of successful retrieval, the browser type and version, the user’s operating system, the referrer URL (i.e. the page previously visited), the IP address and the enquiring provider.

Log information that is unattributable to a user’s identity or other forms of profile generation that comply with the legislative requirements are solely used to conduct statistical analyses that serve to run, secure and optimise our online service. We do, however, reserve the right subsequently to check the log information if there are specific grounds to suspect that the Website has been used unlawfully.

8. Cookies & reach measurement

Cookies are information sent to the user’s web browser by our web server or that of a third-party and stored there for future retrieval. The use of cookies for the purposes of pseudonym-based reach measurement is explained to the users in this data protection statement.

This online service can also be viewed without the use of cookies. Users not wanting cookies to be stored on their computers are requested to deactivate the corresponding option in their browser’s system settings. Saved cookies can be deleted in the browser’s system settings. Disabling the use of cookies may result in the full functionality of this Website being restricted.

9. Contact form

Whenever customers contact us through the contact form, the information they provide there – including the contact details provided – are saved for the purpose of processing the request or enquiry and in the event that there are follow-up questions. We never disclose such data without first obtaining the customer’s consent.

10. Incorporation of third-party services and content

Third-party content or services may, from time to time, be incorporated into our Website, such as city maps or fonts used by other websites. The incorporation of third-party content is always subject to the third-party provider being aware of the user’s IP address, as they are unable to send content to the user’s browser without an IP address. The user’s IP address is therefore required in order for such content to be shown. Providers of third-party content can also use their own cookies and process user data for their own purposes. Usage profiles relating to users may equally be generated in the process. We will apply the principles of data economy and data avoidance when using such content and we will select third-party providers with a reliable record in terms of data security.

Below you will find an overview of third-party providers and their content, along with links to their data protection statements containing further details in respect of how data are processed as well as what options are available to you if you wish to opt out (some of which are also mentioned here):

11. Data retention time

Data that we save are erased as soon as they cease to be required for their intended use and we no longer need such data to conduct statistical analyses, and when their erasure does not conflict with any legal obligations to preserve the data, unless the data must be saved in order to assert, exercise or defend against legal claims.

Customer data are erased after 20 years at all events.

12. Users' rights of withdrawal and rectification

Users have a right to withdraw any consent they may have granted.

Users are entitled to have us correct their personal data immediately if these are inaccurate, and/or complete their personal data without delay should they be incomplete – including by means of providing a supplementary statement.

13. Users' right of access

Users have the right to obtain access to personal data relating to them and to have such information provided in a commonly used electronic form as well as to obtain a personal copy of such data.

Users are required to submit a written, signed request to our postal address in order to obtain access to their personal data.

14. Users' right to erasure of data

Users have the right to require us to delete their personal data if:

  • saving such data is no longer necessary
  • users withdraw their consent to have their data processed
  • the data have been unlawfully processed
  • a legal obligation in EU or Member State law requires such action

The users' right to have their personal data erased does not apply, however, if:

  • the right of freedom of expression and/or freedom of information outweighs the users' rights
  • a legal obligation requires that the data be saved
  • public interest in the area of public health outweighs the users’ rights
  • archiving purposes, scientific or historical research purposes oppose such action
  • the data must be saved in order to assert, exercise or defend against legal claims

Users are required to submit a written, signed request to our postal address in order to have their personal data erased.

15. Amendments to the data protection statement

We reserve the right to amend the data protection statement in order to bring it into line with any changes in legislation or in the event of changes to our service and data processing amendments. This shall only apply in respect of statements as they relate to data processing, however. In the event that users are required to furnish their consent or should elements of the data protection statement contain provisions related to the contractual relationship with users, the amendments will only be made with the users’ consent.

Users are asked to review the content of the data protection statement at regular intervals.
